The decalogue of legal translation - contracts in intercultural legal communication

Abstract: The paper proposes a model for translating contracts which unites different translation stances (Snell Hornby's integrated approach, the functionalist views with the skopos theory and the concept of cultureme, as well as Chesterman's theory of memes) with the findings of comparative law regarding differences between legal systems and their impact on legal languages. The model is structured in ten stages, each addressing one of the specific linguistic and extra-linguistic aspects of the contract as a text type. When translating contracts, a very specific situation may arise with respect to the cultural embeddedness of the target text, since memes of different legal cultures may co-exist at various levels. This is especially the case when the contracting parties decide to use a third language as a lingua franca, which may lack any direct correlation with the legal culture(s) underlying the contract.

Subjective theories and main problems of preschool teacher working with gifted child

Abstract: In this paper, main problems regarding preschool teacher's subjective theories, problems and professional development in working with gifted children are presented. The results of the empirical research show the following problems: preschool teachers are inadequately informed about the issues concerning identifying and working with gifted young children; they tend to have low self-competence in identifying personal characteristics of gifted children and in the appropriate use of teaching strategies when working with gifted children; they stress the necessity for further education and professional training in the field of gifted children education. In addition to various possibilities of further education and in-service training, there are some issues that should be arranged on the national level, e. g.: empowering preschool teachers; providing teaching materials, teaching aids and special - didactic recommendations; shorter training workshops and others

Raziskovanje kognitivnih shem kot individualnih ali skupinskih struktur

Abstract: V prispevku je predstavljenih nekaj značilnosti teorije kognitivnih shem. Ukvarjali smo se z vprašanjem, na kateri ravni naj se raziskujejo kognitivne sheme: na individualni-, nadindividualni-, ali celo na ravni večjih socialnih sistemov, in sicer glede na značilnosti socialne kognicije ter glede na naravo kognitivnih shem. V zadnjem obdobju se raziskovalci kognitivnih shem osredotočajo na interakcijo med motivacijskimi, kognitivnimi in drugimi osebnimi ter situacijskimi spremenljivkami in njihovim vplivom na vedenje. Kognitivne sheme so razumljene kot rezultat medsebojnega prepleta osebnih, okoljskih in situacijskih spremenljivk. Odgovor na zastavljeno vprašanje pa je odvisen tudi od paradigme, znotraj katere raziskovalec raziskuje in od raziskovalnega problema.
